Federal Registerpublishes HUD Final Rule "to address many of the operational challenges facing participating jurisdictions, particularly challenges related to recent housing market conditions and the alignment of federal housing programs." The rule is effective August 23rd, 2013. SALEMONIC

On July 3rd, the Oregon House of Representatives passed, 38 to 20, HB 2639, sponsored by its Speaker, Representative Tina Kotek of Oregon's 44th District. Five days later, it passed the Senate 16 to 13 on the last day of the 2013 legislative session. It is an important piece of legislation. Before its passage, Oregon law prohibited people from refusing to "to sell, lease or rent any real property to a purchaser" the race, color, religion, sex, sexual orientation, national origin, marital status, familial status of any person. HB 2639 expanded the protections to include "or source of income." It does not bar refusal based on a person's prior record, ability to pay or require accepting income from illegal activity. The legislation, Portland Commissioner Nick Fish told The Oregonian, "will ensure that thousands of low-income families in Oregon will have a fairer opportunity to live in the neighborhood of their choosing, This is a very proud day for Oregon."

BIG TIME

In the July 19th Federal Register, HUD published proposed rule that provides its partners with to provide HUD program participants with more effective means to affirmatively further the purposes and policies of the Fair Housing Act of 1967. While the Act expressly prohibits discrimination in housing on the basis race, color, national origin, religion, sex, familial status and disability, it also directs its partners to take steps proactively to overcome historic patterns of segregation, promote fair housing choice, and foster inclusive communities for all. The proposed rule, says HUD Secretary Donovan, will provide "a 21st century approach to fair housing" and includes a more clearly articulated definition of what it means to affirmatively further fair housing, an assessment template that replaces the current, loosely defined Analysis of Impediments, a nationally uniform data and a geospatial tool and clear guidance and technical assistance. CONTINUM-ING

HUD's awarded $2,903,449 to support 31 new homeless housing and service projects of Continuums of Care in Alaska, Idaho, Oregon and Washington state. Alaska was awarded $ $166,038 to support five new projects, Idaho was awarded $57,446 to support three projects, Oregon was awarded $371,275 to support seven projects and Washington state was awarded $2,308,690 to support 16 projects. The awards are in addition to the $89.1 million that HUD allocated earlier this year to renew support for 406 existing homeless projects in the Northwest. The latest funding were largely the result of local strategic decisions that resulted in the reallocation of funds from existing renewal projects that were deemed by a local Continuum of Care no longer critically needed in favor of creating new programs to help the community achieve the goal of ending homelessness.

NEWS TO USE

On July 9th, FHA issued Mortgagee Letter 2013-23 updating the requirements for the Deed-in-Lieu and Pre-Foreclosure options in FHA's Loss Mitigation Program. The changes are effective October 1st.

DOING RIGHT

Earth movers as "background music" pleasant to the ears, pleasing to the soul? "Yep," says The Tacoma Weekly in its story about the Tacoma Housing Authority's July ground breaking for the $15.8 million first phase of the "new" Hillside Terrace in the city's Hilltop neighborhood. "We believe both ugly and lovely are contagious," Authority executive director Michael Mirra says, adding that "We've been trying to tear this place down for 15 years." So, down it's coming and in its place will rise a 6,925-square-foot community education center and 74 of the 140 new apartments that will occupy the almost two-acre site. All in all, says The Weekly, it's "Tacoma, done attractively, proactively and responsibly." It's "Tacoma done right." TO THE RESCUE

Oregon Housing & Community Services has launched a Home Rescue program in 33 counties to assist an estimated 2,500 at-risk homeowners who've experienced an income drop of at least $10,000 from 2011 or 2012. The program, funded by Treasury's "hardest hit" fund, will either provide up to $20,000 in mortgage payments in 12 monthly installments or "reinstatement" payments of up to $10,000 to bring a mortgage current. The program will be opened to eligible, at-risk homeowners in Clackamas, Multnomah and Washington counties at the end of August. SECOND CHANCE

Who says public officials don't read their mail? Folks at the Alaska Housing Finance Corporation certainly do. In January the Corporation announced launch of the 2013 Home Energy Rebate program has provided $10,000 rebates to owner-occupied homeowners who've made their houses more energy efficient with almost 21,000 homes made efficient - with average savings of 30 percent - since the Legislature established the rebate in 2008. Following the January announcement, the Corporation received18 appeals arguing that owners who previously had received a rebate for making one home efficient should be eligible it they since have sold that house, bought a new home and made it similarly efficient. "After a careful review," the Corporation has okayed "expansion of" the Rebate "for Alaskans participating a second time."

EARLY START

"For children in poverty," reports Home Forward, the housing authority of Portland, "for children in poverty, chronic absence in kindergarten predicted the lowest levels of educational achievement at the end of 5th grade. even if children's attendance improved after kindergarten." During the 2009-2010 school year, the authority says, "29% of kindergarteners" in Multnomah County "were chronically absent." Not for long, thanks to a Families Forward initiative it launched in early 2012 to step-up its outreach to parents of kindergarteners in its public and assisted housing. That's about 500 kids or 7 percent of the County's kindergarten-age population. The initiative's already paying off. At the start of the 2010-2011 some 69.2 percent of its kindergarteners had registered by September 1st. Thanks to the outreach initiative, by the start of the next school year 79 percent had - with increases in six of the seven Portland Public School clusters, every racial/ethnic group except Native Americans and every language group. And the initiative's not done. About half of the Home Forward's kids live in East County and aren't served by Portland schools. So, the authority' launch a similar outreach effort there while continuing outreach where it's already had such success. PAY OFF

Kurt Wiest, the executive director of the Bremerton Authority, has reason to be happy his authority has invested so much of its time and not a little bit of its money to fire safety in all its properties. On July 24th a mattress fire started in an apartment at a complex owned and operated by the authority. A woman had been smoking in bed and then dozed off. When the alarm began to sound, she continued to sleep. But the suppression system, Wiest tells the regional newsletter of the National Fire Sprinkler Association, "worked as it was designed." He's "very satisfied" that it die since, as Bremerton's Fire Marshal noted, otherwise "this would have been a fatality."

FROM WHERE TO WHAT

Where do they all come from? See a homeless man huddled in a doorway, a homeless trying to get comfortable in the backseat of a beat-up car and, maybe, it's a question you've asked in your community. And it's a question to which Alaska Housing Finance Corporation has some preliminary answers based on its one-night, point-in-time count in Anchorage. "The majority of chronically homeless people in Anchorage," it told KSKA Radio, "are Alaska Native, and most of them are from Northern and Western Alaska." And what does that mean to the Corporation. "In formulating a program or a response," says Kris Duncan, it's "not just about homelessness" but also "the trauma of going from a longstanding rural lifestyle to that of a more urban centered lifestyle." King County, the City of Seattle, ARCH: A Regional Coalition for Housing, Building Changes, United Way of King County, the King County Housing Authority and the Seattle Housing Authority have released their "streamlined," combined, 2013 Notice of Funding Availability to award some $45.5 million to provide capital funds for new affordable housing and for operating support, rental assistance and supportive services for existing housing serving the homeless. NOFA-TWO- -NITY

Treasury's Community Development Financial Institutions has opened the application process for calendar year 2013 and 2014 New Markets Tax Credit funds totaling $8.5 billion. spurs investment of private sector capital into distressed communities by providing a tax credit to corporate or individual taxpayers who make qualified equity investments in designated Community Development Entities which, in turn, invest the capital raised into projects and businesses in low-income communities. To date, the CDFI program has award more than $365 billion in credits. The deadline for certification as a Community Development Entity is August 9th and September 18th the deadline to apply for New Markets Tax Credits with national conference calls outlining the New Markets program on July 30th and August 1st. The City of Seattle's Office of Housing has set a September 12th deadline to apply for "approximately $21 million" under its Rental Housing Program "to support the production and preservation of rental housing that will provide long-term affordability." The funding is "various affordability restrictions and geographic priorities" and intended to advance of the City's Rental Housing Program. In partnership with the American Planning Association, HUD is now accepting nominations for in partnership 16th annual HUD Secretary's Opportunity and Empowerment Award. The Award recognizes excellence in planning that has led to measurable benefits in terms of increased economic employment, education, or housing choice or mobility for low- and moderate-income residents. "Housing authorities rarely make headlines. When they do, it's rarely in a good way. The Tacoma Housing Authority is proving itself the exception. In recent years, the THA has been reinventing subsidized housing - radically reinventing it. . .The strings normally attached to federal housing funds have required local housing authorities to increase a family's subsidies if its income went down and cut if its income went up. As long as the household fits the formula, the subsidies don't stop. But housing authorities have a problem that federal welfare doesn't. There is never enough money to help every family that can't afford a decent place to live. . .As THA executive director Michael Mirra has said, "we serve a small group of lucky families who potentially have lifetime subsidies. And there's this hideous waiting list of many thousands more who receive nothing." Under the authority's new Housing Opportunity Program, the subsidies are cut from about 59 percent to 50 percent of the standard rent level, allowing the THA to help more families. The amount remains fixed. Heads of households can get jobs and make more money (up to a certain point) without forfeiting the assistance. If they lose jobs and income, they don't get more. All the incentives - including the five-year maximum - are designed to encourage work and personal responsibility. The deadline doesn't apply to the disabled and elderly. If the deadlines and subsidy caps sound like the harsher side of tough love, consider the many thousands of needy families who've been shut out from rent subsidies entirely as the lucky few kept them indefinitely. . .All of this promises to help its clients break out of the cycle of poverty. COMMON SENSE

Common sense might cause you to think that life in big city like Boise would be more expensive than in a small town, right? Not so says the Economic Policy Institute in Washington, D.C. Its model shows is costs more to "get by" in rural Idaho than in cities like Boise, Idaho Falls or Lewiston. "Since 2010, the number of homeless veterans encountered during the annual homeless census decreased nearly 60 percent. At the Whatcom Homeless Service Center, we used to routinely have upwards of 40 homeless veterans on our radar at any point in time. Lately, we are routinely down to single digits. . .The total number of homeless veterans decreased from 163 in 2010 to 69 in 2013. The number of unsheltered veterans also decreased, from 81 in 2010 to 21 in 2013.
