FROM CLARIFICATION TO PARTICIPATION
Addressing impediments to mortgage lending
HUD Secretary Ben Carson & Attorney General William Barr have signed a memorandum of understanding between their two agencies offering guidance & clarification on the appropriate use of the Fair Claims Act for violations by Federal Housing Administration – FHA - lenders so that the Act's requirements, Secretary Carson explained, "do not impede or discourage lenders from offering affordable FHA-insured loans to credit-worthy borrowers. "In taking these steps, we are fulfilling an important element of our Housing Finance Reform Plan & making clear to all responsible lenders that FHA's mortgage program is a program they should participate in. At the same time, HUD will not tolerate irresponsible or fraudulent lenders who defraud borrowers & taxpayers." The memorandum, Attorney General Barr noted, "sets forth a robust and collaborative process for deciding when to pursue False Claims Act cases to remedy material & knowing FHA violations." It is intended, said the announcement, to "address concerns that uncertain and unanticipated FCA liability for regulatory defects led to many well-capitalized lenders, including many banks and credit unions statutorily required to help meet the credit needs of the communities in which they do business, to largely withdraw from FHA lending." In a speech to mortgage bankers in Austin, Texas, Bloomberg reported, Secretary Carson remarked that "depository institutions, which represented nearly half of FHA's lender base in 2010, represent just 15 percent today" & "that at least part of the reason for the decade-long decline in depository participation is because of the uncertainly about how federal agencies apply the False Claims Act."

"RAD IS WORKING"
Opening the door to private capital for housing authorities
A recent analysis of HUD's Rental Assistance Demonstration program to increase the access of public housing authorities to private investment capital reported that "a total of 956 public housing projects with 103,268 units of public housing converted. . .These projects raised a total of $12.6 billion of capital through a variety of sources, an average of $121,747 per unit." That's an average of $121,747 of available capital for each unit converted to RAD. Closer to home, as of October, 2019 the RAD Resource site showed almost 3,100 of those converted units are owned and operated by housing authorities in Salem, Lane County, Portland and Multnomah County, Oregon, Everett, Grays Harbor County, Yakima, Vancouver and Tacoma, Washington and the Idaho Housing and Finance Association. To date, the conversions have generated $192.8 million in construction investments and created some 3,700 direct and indirect jobs. Another 1,240 units are in the "pipeline" to be converted. "RAD is working," said HUD Secretary Carson of the evaluation. "Our aging public housing stock is at extreme risk of being lost. The capital needs of these properties are beyond what we can hope to get from Congress. RAD provides us the solution to preserve this critically needed housing so it remains permanently affordable for future generations."

President nominates Montgomery
President Donald Trump has announced that he intends to nominate Brian D. Montgomery as Deputy Secretary of Housing & Development, a position in which he serves in an acting capacity. The White House announcement noted that Mr. Montgomery "has served as head of the Federal Housing Administration – FHA - twice, and under three different administrations," and adds that "with more than 30 years of experience in both the public & private sectors, including his first term as Commissioner from 2005 to 2009, Mr. Montgomery brings to HUD a deep knowledge of housing issues & vast experience spearheading large-scale policy initiatives."

Preparedness pays-off
Over the past few decades the City of Mt. NOFA-TUNITY
HUD re-opens a funding stream
HUD has set a February 10th deadline for eligible non-profits to apply for a total of $112 million under its Section 811 Supportive Housing for Very Low-Income Persons with Disabilities. It is the first time in some 9 years that HUD has had a Section 811 funding competition. This year's competition will award $75 million in up to 30 Capital Advance grants of no more than $2.5 million "for the development of permanent supportive rental housing for very-low-income persons age 18 years or older" as well as $37 million for Section 811 project rental assistance. "Very simply," said HUD Secretary Carson in announcing the opening of the competition, "we need more permanent supportive housing to assist persons living with disabilities. The funding we offer today will support existing developments and, for the first time in nearly a decade, help to produce new affordable housing at a time we need it the most.".

NOFA-TWO-NITY
Keeping families together
HUD has set a December 17th deadline for public housing authorities with existing Housing Choice Vouchers to apply for a total of $20 million in Family Unification Program funds which enable them, in partnership with local public child welfare agencies, provide rental vouchers to "families for whom the lack of adequate housing is a primary factor in the imminent placement of the family's child, or children, in out-of-home care" – such as foster care – "or the delay in the discharge of the child, or children, to the family from out-of-home care; and Youth at least 18 years and not more than 24 years of age" (i.e., have not reached their 25th birthday) "who left foster care, or will leave foster care within 90 days" & "are homeless or are at risk of becoming homeless at age 16 or older." Authorities must have an executed memorandum of understanding with the child welfare agency as well as the local Continuum of Care as described in the funding announcement. Up to 40 grants may be competitively awarded with none larger than $1.2 million.

The Washington State Department of Commerce's Public Works Board has set a November 14th deadline for cities, towns, counties, Tribes, port districts & others to apply for planning & feasibility study grants for broadband infrastructure in unserved areas. Up to 10 grants of no more than $50,000 each are expected.

Housing & helping rural vets
The Housing Assistance Council has set a November 15th deadline for noon-profit housing development organizations to apply for grants of up to $30,000 funded by The HomeDepot Foundation bricks-&-mortar projects that assist low-income, elderly and/or disabled veterans in rural areas with home repair & rehab needs, support homeless veterans, help veterans become homeowners, and/or secure affordable rental housing."
