The following summaries provide information on the date that HOME waivers were granted and denied, the State or Local Field Office making the request, the situation which gave rise to the need for a program waiver, and the regulatory citation. 4/4/01 AL Waiver request granted permitting the Alabama Housing Finance Agency to count as match: sweat equity contributions; the value of donated property; and the yield foregone below market interest rate loans purchased from Habitat for Humanity. All match contributions were made to Habitat units that were not assisted with HOME. 6/15/01 TX Request granted to waive the use of eligible pre-award costs for administrative and planning expenses prior to the beginning of the participating jurisdiction's consolidated plan year. 6/26/01 AL Waiver request denied to the Alabama Housing Finance Authority (AHFA) to count as match the contribution of mortgage revenue bond proceeds to multifamily projects that are not assisted with HOME funds. 9/07/01 NC Waiver request denied. The city of Greensboro, NC requested a waiver permitting it to expend additional HOME funds to help assist the city in salvaging an affordable housing project that has been besieged with problems associated with neighborhood crime and vagrancy, as well as poor management.92.214 (a)(7) (http://edocket.access.gpo.gov/cfr_2004/aprqtr/24cfr92.214.htm)
10/01/01 NM Waiver approved permitting the State to substitute a 50-year lease term when assisting homeownership on tribal lands. 10/05/01 AL Waiver request neither granted nor denied. The State had requested a waiver of the written rehabilitation requirements for units assisted through the State's Rehab Assistance Program. These units were not assisted with HOME funds, although the State proposed to use contributions to such units as match for its HOME program. The State had not imposed written rehabilitation standards on the units in question. However, HUD is willing to examine the written quality standards of the Home Builders Association of Alabama to see if these might meet the requirements of the HOME program. HUD requested that the State provide copies of these standards for the Department to review. 11/06/01 PA Waiver approved, although it limits the scope of what was originally requested by Delaware Co., PA. The original request was for HUD to waive the 36-month deadline requirement for the transformation of lease-purchase properties to homeownership units on ten lease-purchase properties. 11/20/01 PR Waiver approved extending the expenditure deadline for the Municipality of Carolina's 1995 HOME allocation. The lack of a functioning CHDO and project delays caused by unanticipated circumstances affected the PJ's ability to spend its HOME allocation in a timely manner. 11/20/01 WI Waiver of property standard and project completion requirements approved. 12/20/01 NJ Waiver of repayment requirement approved. Burlington Co. had invested HOME funds into a CHDO-sponsored acquisition-rehabilitation project that was subsequently terminated before completion.
